Privacy and transparency can sometimes appear to be competing obligations in a sectional title scheme - but POPIA does not mean “no disclosure”. Trustees need to understand how to balance the protection of personal information with an owner’s statutory right to access body corporate records.
In this trustee training session, we unpacked the responsibilities of trustees and the Information Officer in ensuring POPIA and PAIA compliance, including appropriate systems, controls and procedures for managing personal information.
We also considered practical issues such as owner and debtor information, CCTV, biometric access systems, visitor records, WhatsApp groups, email distribution lists and information shared with contractors and service providers.
Importantly, we explored how POPIA, PAIA, the STSMA and the prescribed management rules work together when owners request information, including when redaction or limited disclosure may be more appropriate than refusing access altogether.
This practical session helped trustees better understand their obligations, manage information responsibly and promote a culture of transparent, compliant and trusted scheme governance.
