Getting common property resolutions right

For our October 2025 webinar, we considered one of the most misunderstood and contested areas in sectional title management. When an exclusive use area (EUA) or sectioned-off portion of common property is approved, does it amount to alienating common property?

 Many bodies corporate have set precedents, sometimes informally, by allowing owners to enclose, develop, or use portions of common property without a clear resolution or registration process. These decisions can have long-term implications for the scheme, neighbouring owners, and the trustees themselves.

 This training session examined the legal, procedural, and practical aspects of adopting resolutions that affect common property, EUAs, or sectioned-off areas within a sectional title scheme.
